These Terms of Service ("Terms") govern your access to and use of the MotoTrackIQ website, software, analytics reports, and any related hardware rental or sale (collectively, the "Services") provided by MotoTrackIQ, a sole proprietorship operating in Ontario, Canada ("MotoTrackIQ", "we", "us", or "our"). By creating an account, uploading data, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the Services. By using the Services you represent that you meet this requirement and that the information you provide is accurate and complete.
MotoTrackIQ provides web-based analytics that process motorcycle track-day telemetry and lap data you upload, generating performance analysis reports. We may also offer rental or sale of telemetry transponder hardware and links to third-party ("affiliate") vendors. Specific features, tiers, and pricing are described on our site and may change over time.
You retain ownership of the telemetry, ride data, and other content you upload ("Your Content"). You grant MotoTrackIQ a limited, non-exclusive licence to store, process, and analyze Your Content solely to provide the Services to you and, in aggregated and de-identified form, to improve the Services. We do not sell Your Content.
MotoTrackIQ reports are for informational and entertainment purposes only. Motorcycle riding and track-day activities are inherently dangerous. Our analytics do not constitute coaching, instruction, or a recommendation to ride at any speed, line, or level. You are solely responsible for your riding decisions and safety. Always ride within your limits, follow all track and event rules, and wear appropriate safety gear. MotoTrackIQ is not liable for any injury, death, or damage arising from your use of the reports or the Services.
The Services may contain links to third-party vendors or products. We may earn affiliate commissions from such links. We are not responsible for third-party products, services, or content, and your dealings with them are solely between you and the third party.
The Services, including software, report templates, branding, and site content (excluding Your Content), are owned by MotoTrackIQ and protected by intellectual property laws. We grant you a limited, non-transferable, revocable licence to use the Services for your personal, non-commercial use.
The Services are provided on an "as available" basis and may include beta or experimental features. We do not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue features at any time.
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the analytics or reports are accurate, complete, or reliable.
To the maximum extent permitted by law, MotoTrackIQ and its owner shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Services. Our total aggregate liability for any claim shall not exceed the greater of (a) the amount you paid to us in the 12 months preceding the claim, or (b) CAD $100.
You agree to indemnify and hold harmless MotoTrackIQ and its owner from any claims, damages, or expenses arising from your use of the Services, Your Content, or your violation of these Terms.
You may stop using the Services and request account deletion at any time. We may suspend or terminate your access for violation of these Terms or misuse of the Services. Sections that by their nature should survive termination (e.g., disclaimers, limitation of liability, indemnification) will survive.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada.
We may update these Terms from time to time. Material changes will be posted on this page with a revised "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance.
